Pavwell legal

Terms of Service

These terms apply to Pavwell domains, DNS, hosting, business email, website, app, billing, and related customer services.

Effective date: 17 October 2026

1. Agreement and provider

These Terms of Service ("Terms") govern your use of Pavwell Hosting, the customer portal at my.pavwell.co.zw, and Pavwell domains, DNS, hosting, email, website, app, and business services (together, the "Services"). By creating an account, placing an order, or using a Service, you agree to these Terms and the Privacy Policy.

"Pavwell", "we", "us", and "our" mean the Pavwell business that operates the Services. If you use a Service for a company or another person, you confirm that you have authority to bind them. If you do not accept these Terms, do not use the Services.

2. Account and security

You must provide accurate, current information and keep it updated. You are responsible for activity under your account, your passwords, OTPs, API tokens, mailbox credentials, team invitations, and domains connected to your account.

Do not share credentials, bypass access controls, impersonate another customer, or allow a person to use your account outside the permissions you grant. Tell us immediately at support@my.pavwell.co.zw if you suspect unauthorised access. We may require identity or ownership verification before changing an account, domain, DNS zone, or service.

3. Orders and service activation

The shop, plan description, options, quantity, currency, billing interval, and checkout summary form the basis of an order. An order is not accepted until payment is confirmed or we expressly accept it. We may correct an obvious pricing, availability, or description error and will give you the option to cancel the affected order where required.

After confirmed payment, a service may show Processing while Pavwell or a provider provisions it. Domain registration, DNS delegation, certificates, hosting, and mailbox creation can have different completion times. A pending domain may be assigned to hosting for setup and preview, but public website traffic and email delivery depend on domain and DNS activation.

4. Domains and DNS

Domain registrations, renewals, transfers, and disputes are also subject to the rules of the relevant registry, registrar, and domain extension. You must provide truthful registrant details, meet eligibility requirements, and respond to verification requests. A registration request is not a guarantee that a registry will accept or continue the domain.

Domain prices, periods, availability, nameservers, DNS records, and renewal dates are shown in the portal. Availability can change before registration. You authorise us and our providers to submit the domain request and manage the nameservers or DNS changes you choose.

You are responsible for reviewing DNS changes before approving them and for maintaining records needed for services you do not ask us to manage. DNS propagation is outside our control. We may suspend, lock, or alter DNS for an expired domain, abuse, security incident, legal requirement, or registry instruction.

5. Web hosting

Hosting includes the storage, website access, resources, tools, and features listed for your selected plan. Limits, fair-use rules, storage allocations, mailbox allocations, backups, certificates, and add-ons apply as shown at checkout or in your dashboard.

You may upload and operate lawful website content that you own or are authorised to use. You are responsible for your files, applications, visitors, backups of important content, software updates, and any credentials or third-party integrations. A preview URL is provided for testing where available and is not a guarantee of public availability or search indexing.

We may perform maintenance, security updates, migrations, resource protection, or emergency actions. We will take reasonable steps to limit disruption, but no uninterrupted or error-free service is promised unless a separate written service commitment applies.

6. Business email

Email hosting provides mailboxes, storage, webmail, and supported connection details according to the selected plan. You must choose a domain you own or are authorised to use. Mailboxes can be created after the domain is active and its mail DNS is ready.

You must not use Pavwell email for spam, deceptive bulk mail, phishing, malware, harassment, unlawful content, compromised-account activity, or sending that damages the reputation or deliverability of our systems. We may limit, quarantine, suspend, or remove abusive messages, mailboxes, or accounts.

Mailbox storage, retention, delivery, filtering, and third-party mail-client behaviour depend on the plan and provider. Keep independent copies of important messages where appropriate.

7. Website, app, and business projects

Website design, app development, booking, payment, ticketing, chatbot, and advanced-flow services are delivered according to the selected scope, options, brief, and communications with Pavwell. A service price does not transfer ownership of third-party software, stock assets, domains, or licences.

Unless a project agreement says otherwise, you provide timely content, approvals, access, and accurate requirements. Delays caused by missing materials, changed requirements, third-party approvals, or late feedback may change delivery timing or price. Final ownership or licence rights transfer only after the applicable project fees are paid and any third-party restrictions are satisfied.

8. Prices, taxes, and payment

Prices are shown in the currency and period displayed at checkout. Domains generally renew yearly; hosting or other recurring Services may be monthly or yearly; project Services may be one-time. Taxes, registry fees, provider charges, payment charges, or other mandatory amounts will be shown or communicated where applicable.

You authorise the selected payment provider to process the amount. We do not store full card numbers or mobile-money PINs. A general balance deposit is different from a renewal deposit. A deposit started from a specific Renew action is reserved for that service and renewal period.

You must not reverse, dispute, or cancel a legitimate payment without first contacting us. We may pause provisioning while a payment is pending, reversed, disputed, fraudulent, or under review.

9. Renewals, expiry, and suspension

Each renewable domain or Service has its own period and due date. The dashboard lists them separately. You are responsible for maintaining enough funds and renewing before expiry unless an active auto-renewal arrangement applies.

After expiry or an overdue payment, we may restrict access, suspend website traffic, disable mailboxes, stop DNS editing, scramble or replace domain nameservers where permitted, or place a branded suspension page on a hosted website. Suspension does not delete your files or waive amounts owed. Renewal restores an eligible Service after payment confirmation and provider recovery; restoration may require additional time.

Domains can be deleted, auctioned, released, or incur registry redemption fees under the applicable registry rules. We do not promise that an expired domain can be recovered.

10. Acceptable use

You must not use the Services to violate law, registry rules, sanctions, another person’s rights, or network security. Prohibited conduct includes malware, phishing, credential theft, unlawful surveillance, exploitation, copyright infringement, fraud, impersonation, abusive scanning, denial-of-service attacks, unauthorised access, spam, botnets, illegal content, or activity that harms other customers or provider infrastructure.

We may investigate credible reports, preserve evidence, cooperate with authorities, remove content, limit access, suspend a Service, or terminate an account when reasonably necessary. We will provide notice where lawful and practical.

11. Intellectual property and customer content

Pavwell and its licensors retain rights in the portal, software, designs, documentation, trademarks, and platform materials. We grant you a limited, non-exclusive, revocable right to use the Services during the paid period.

You retain your rights in content you upload or provide. You grant us and our providers the limited licence needed to host, copy, transmit, back up, scan for security, and process that content to provide the Services. You confirm that you have the rights and permissions needed for that content.

12. Third-party services

Services may depend on payment providers, registries, Cloudflare, hosting panels, mail systems, certificate authorities, registrars, APIs, or other third parties. Their terms, availability, verification requirements, and outages may affect your Service. We are not responsible for a third party’s independent acts or policies, but we will take reasonable steps to investigate provider failures and communicate material impact.

13. Cancellations, refunds, and consumer rights

Request cancellation or a refund by contacting billing@techinn.co.zw with your account email, order or invoice reference, and reason. Refund eligibility depends on the Service, whether provisioning or registration has started, registry rules, provider charges, project work already performed, and applicable consumer law.

Nothing in these Terms excludes or limits a right or remedy that cannot lawfully be excluded or limited under Zimbabwean law. If a Service is defective or materially different from its description, contact us promptly so we can investigate and offer an appropriate remedy where required.

14. Availability, warranties, and liability

To the extent permitted by law, the Services are provided on an as-available basis and we do not promise that they will be uninterrupted, error-free, secure against every threat, or suitable for every purpose. We do not guarantee domain availability, search ranking, email delivery to a particular recipient, uninterrupted DNS propagation, or third-party uptime.

To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, or loss-of-profit damages, or loss caused by content, credentials, missed renewal, DNS changes, third-party failure, unlawful use, or failure to keep independent backups. Our total liability for a claim relating to a paid Service is limited to the amount you paid for that Service in the twelve months before the event giving rise to the claim, except where a higher limit is required by law or a separate written agreement applies.

15. Indemnity

To the extent permitted by law, you agree to defend and hold Pavwell and its providers harmless from claims, losses, costs, and reasonable expenses arising from your unlawful use of the Services, your content, your domain or DNS instructions, your breach of these Terms, or your infringement of another person’s rights.

16. Termination

You may stop using a Service or request account closure, subject to unpaid amounts, registry rules, active project work, retention duties, and any applicable refund rights. We may suspend or terminate a Service for non-payment, abuse, security risk, legal requirement, provider termination, or material breach.

Sections concerning payment, content, intellectual property, acceptable use, liability, indemnity, dispute resolution, and information retention continue after termination where their nature requires.

17. Governing law and disputes

These Terms are governed by the laws of Zimbabwe, subject to mandatory consumer protections. Contact support first so we can try to resolve a complaint. If we cannot resolve it, either party may use a court or other lawful dispute-resolution forum with jurisdiction in Zimbabwe.

Nothing prevents a consumer from using a statutory complaint, regulator, small-claims, or other remedy available under applicable law.

18. Changes and general terms

We may update these Terms when Services, providers, or legal requirements change. We will publish the updated version with a new effective date and give additional notice where required. Continued use after the effective date means the updated Terms apply to future use; accrued rights and obligations remain governed by the version applicable when they arose.

If a provision is invalid, the rest remains effective. Failure to enforce a provision is not a waiver. These Terms and any order, plan, or project document incorporated into them form the agreement for the relevant Service. You may not assign your account without our written consent; we may assign these Terms as part of a business or Service transfer.
